Breves reflexões sobre as possíveis causas da hiperjudicialização das relações sociais no Brasil

O artigo objetiva identificar as causas do fenômeno da hiperjudicialização das relações sociais no Brasil empregando a revisão bibliográfica como método, considerando fatos históricos interpretados pela perspectiva de autores que analisaram filosoficamente e sociologicamente a temática: Antoine Garapon, Axel Honneth e Ingborg Maus. A investigação concluiu que ao relacionar as teses com a conjuntura brasileira pós-1988, visualiza-se certa infantilização da sociedade associada à crença de que o juiz seria o guardião das boas virtudes e, também, a patologia social da liberdade jurídica: que faz com que o indivíduo se enxergue apenas como portador de direitos, fomentando a hiperjudicialização da sociedade.

Brief reflections on the possible causes of the hyperjudicialization of social relations in Brazil

This article aim to identify the causes of the hyperjudicialization phenom on the social relationship in Brazil applying bibliographic review method, departing from the historical facts interpreted by philosophical and sociological point of view of Antoine Garapon, Axel Honneth e Ingborg Maus. This investigation concludes, by relating the theoretical contributions and the Brazilian conjuncture, it´s possible to visualize kind of infantile threatment of society and the social pathology of legal freedom: that makes the individual look at himself only as rights bearer, guiding their interpersonal relationships by the legal objective desired, and, therfore, resulting in the hyperjudicialization of the society.
